Privacy Policy

1. Who we are
Nysus, LLC ("Nysus," "we," "us" or "our") is a technology consulting firm serving small and medium-sized businesses. This Privacy Policy explains how we collect, use, share and protect personal information when you visit nysus.io (the "Site"), contact us, or communicate with us by phone, email or text message.
This policy does not cover information we handle on behalf of our clients while delivering services. That information is governed by our agreement with the client (see Section 6).
2. Information we collect
Information you give us
- Contact form. Your name, email address, phone number, industry, company size, the main reason you're contacting us, anything else you choose to tell us, and whether you agreed to receive text messages.
- Communications. What you send us by email, phone or text, and our notes from calls and meetings with you.
- Business details. If you become a client, contact and billing details for you and your organization, and the information needed to scope and deliver our services.
Please don't send passwords, payment card numbers, health information or other sensitive information through the contact form.
Information collected automatically
- Server logs. Like most websites, our servers record your IP address, browser type, the pages you request, the referring page and the date and time. We use these logs to run, secure and troubleshoot the Site.
- Security check. Our contact form uses Cloudflare Turnstile to tell people from automated bots. Turnstile reviews signals from your browser and device to do this. See Section 7.
We do not use advertising cookies, cross-site tracking or third-party analytics on the Site.
Information from others
We may receive your contact details from someone who refers you to us, or find business contact information that is publicly available, such as on your company's website.
3. How we use information
- To respond to your inquiry, schedule a consultation and follow up with you.
- To prepare proposals and agreements, and to deliver, support and bill for our services.
- To send text messages you have agreed to receive (see Section 4).
- To send service-related emails, and occasional updates about our services, which you can opt out of at any time.
- To protect the Site, our business and our clients from fraud, spam and abuse.
- To meet legal, tax, accounting and regulatory obligations, and to enforce our agreements.
- To understand and improve our services.
We do not sell your personal information, and we do not share it for targeted advertising.
4. Text messaging
If you tick the text-message box on our contact form, or otherwise give us your consent, Nysus, LLC will send text messages about your inquiry, including scheduling and follow-up, to the mobile number you provided. Giving consent is optional and is not a condition of any purchase.
- Message frequency varies with your inquiry.
- Message and data rates may apply, according to your mobile plan.
- Reply STOP at any time to stop receiving texts. We'll send one message confirming you've opted out.
- Reply HELP for help, or contact us at (470) 703-9868 or leads@nysus.io.
- Carriers are not liable for delayed or undelivered messages.
We do not share or sell mobile information to third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties. Sharing information with subcontractors that help us provide our services, such as the phone and messaging providers that deliver our texts, is permitted. Those providers may use it only to provide that service to us.
Our Terms of Service include the full terms of our text-messaging program.
5. How we share information
We share personal information only as described here, and subject to the text-messaging commitments in Section 4:
- Service providers that act on our behalf and under confidentiality obligations, such as cloud hosting (Amazon Web Services), email delivery (Amazon SES), our business email and productivity tools, phone and messaging carriers, and bot protection (Cloudflare).
- Professional advisers, such as lawyers, accountants and insurers, as needed for their work for us.
- Legal and safety reasons: when required by law or legal process, or when needed to protect the rights, property or safety of Nysus, our clients or others.
- Business transfers: in connection with a merger, acquisition or sale of all or part of our business, in which case this policy continues to apply to the information transferred. Text messaging opt-in data and consent are excluded from any such transfer.
- With your permission, or at your direction.
6. Client data in our engagements
When we deliver services, we may access our clients' systems and the data stored in them. We handle that data as a service provider, only to perform the services, and under the confidentiality, security and data-protection terms of our written agreement with the client. Where those terms differ from this policy, the agreement governs. If you are a client's employee or customer, please contact the client about how they handle your information.
7. Cookies and security checks
The Site itself does not set advertising or analytics cookies. Cloudflare Turnstile, which protects our contact form, may set cookies or read browser and device signals that are strictly necessary to tell people from bots. Cloudflare's handling of that information is described in the Cloudflare Privacy Policy.
8. How long we keep information
We keep inquiry information for as long as needed to respond and follow up, and generally for no more than three years after our last contact if you don't become a client. Client information is kept for the length of the relationship and afterwards as required by our agreements, by law, or to resolve disputes. We keep records of text-messaging consent and opt-outs for as long as needed to show we honored them. Server logs are kept for a short period for security and troubleshooting.
9. How we protect information
We use administrative, technical and physical safeguards appropriate to the information we hold, including encryption in transit, access controls and the principle of least privilege. No system is perfectly secure, so we can't guarantee absolute security, but we work to protect your information and will notify you of a breach where the law requires it.
10. Your choices and rights
- Text messages: reply STOP to any message to opt out.
- Email updates: use the unsubscribe link in any marketing email, or contact us.
- Access, correction and deletion: you may ask us for a copy of the personal information we hold about you, or ask us to correct or delete it. We'll respond within the time the law requires, and may need to verify your identity first.
Depending on where you live, you may have additional rights under state privacy laws, such as the right to know how we use your information or to appeal a decision about your request. We will not discriminate against you for using any of these rights. To make a request, email privacy@nysus.io or use the other details in Section 13.
11. Children
The Site and our services are intended for businesses and are not directed to children under 16. We don't knowingly collect personal information from children. If you believe a child has given us information, contact us and we'll delete it.
12. Changes to this policy
We may update this policy from time to time. When we do, we'll change the date at the top of this page and, if the changes are significant, take reasonable steps to let you know. We will not use text-messaging consent for any new purpose without asking you again.
